Terms of access to and use of the Croplantains website.

1. Website owner

This website, available at croplantains.com.gt (the “Site”), is operated by Raxwinaq, Sociedad Anónima (“Croplantains”, “we”), tax ID (NIT) 94154996, with registered address at Camino Principal Santa Julia, Línea C-18, zona 0, San Andrés Villa Seca, Retalhuleu, Guatemala.

2. Purpose and acceptance

These Terms and Conditions govern access to and use of the Site. By browsing the Site, you declare that you have read and understood them.

When you submit a form, you will be asked to accept them expressly by means of a separate checkbox. That acceptance is recorded as an electronic communication, which the Law for the Recognition of Electronic Communications and Signatures (Decree 47-2008) recognizes as legally valid and as evidence.

3. Informational nature of the Site

The Site provides information about Croplantains, its products, its production areas, its sustainability practices and its job opportunities.

The information published is general in nature and does not constitute a binding offer. Supply conditions, quantities, specifications and prices are agreed in writing in each commercial relationship. Under Decree 47-2008, a communication not addressed to specific persons is considered an invitation to make offers.

4. Permitted use

You agree to use the Site lawfully and not to:

  • Provide false information, or third-party information without their authorization, in the forms.
  • Attempt to access systems, accounts or databases without authorization, or alter, damage or disrupt the Site. Such conduct may constitute computer crimes under the Guatemalan Criminal Code.
  • Introduce malicious software, send unsolicited mass communications or use automated means to extract content.
  • Use the content of the Site for commercial purposes without prior written authorization.

5. Intellectual property

The texts, photographs, design, logos and the Croplantains brand belong to Croplantains or are used under license. They are protected by the Copyright and Related Rights Law (Decree 33-98) and the Industrial Property Law (Decree 57-2000). Their reproduction, distribution or modification requires prior written authorization.

Some photographs come from image banks under licenses that allow commercial use.

GLOBALG.A.P. and Rainforest Alliance are trademarks of their respective owners. They are displayed solely to inform about the certifications held by Croplantains. Croplantains is a company independent of both organizations.

6. Links to third-party sites

The Site contains links to third-party sites, such as Google Maps or Rainforest Alliance. Croplantains does not control those sites and is not responsible for their content or their privacy policies.

7. Forms and employment

The data you submit through the forms is processed in accordance with our Privacy Policy. Submitting a form does not create a commercial or employment relationship.

Job applications do not guarantee employment. Selection processes are carried out in accordance with Guatemalan labor law and without discrimination.

8. Availability and liability

We strive to keep the Site available and its information accurate and up to date, but we do not guarantee that it will operate without interruptions or errors.

To the extent permitted by law, Croplantains is not liable for damages arising from the use of the Site or the inability to use it.

9. Changes

We may update these Terms and Conditions. Each version states its number and effective date. The acceptance recorded in a form corresponds to the version in force at that time, and we keep the text of each version.

10. Governing law and jurisdiction

These Terms and Conditions are governed by the laws of the Republic of Guatemala. Any dispute shall be submitted to the competent courts of the Republic of Guatemala. This English text is a translation; in case of discrepancy, the Spanish version prevails.
